Terms of Service and Privacy Policy for Flag Sonar

1. Acceptance of Terms

By creating an account or using Flag Sonar ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Flag Sonar LLC ("we," "us," or "our") operates flagsonar.com and all related services.

2. Description of Service

Flag Sonar is an AI-powered social media audit tool. You upload your own social media data archives, and our system analyzes them to identify content that may pose a reputational risk. We do not access your social media accounts directly. All scanning is performed on data you voluntarily provide.

3. Eligibility

You must be at least 18 years old to use Flag Sonar. By using the Service, you represent that you meet this requirement. The Service is intended for use in the United States. Use from other jurisdictions is at your own risk and subject to applicable local laws.

4. Your Archive Data

You may only upload and scan social media archives that belong to you. You must be the registered owner of the account from which the archive was downloaded.

4.1 Ownership Requirement

Uploading an archive that belongs to another person — even with their knowledge — without their explicit written consent is strictly prohibited. Violations may result in immediate account termination and may constitute a violation of applicable federal and state privacy laws, including but not limited to the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and applicable state privacy statutes.

4.2 Self-Certification

By checking the certification box at the time of upload, you confirm under penalty of account termination that the archive you are submitting belongs to you and that you are the authorized account holder. This certification is logged with a timestamp.

4.3 Data Handling

Your uploaded archive is processed and permanently deleted from our systems after scanning is complete. We do not store, sell, or share your raw archive data. We retain only the specific findings generated by the scan, associated with your Flag Sonar account. You may delete your findings at any time, and they will be permanently removed from our database.

5. Payments and Refunds

5.1 Pricing

Flag Sonar offers a free tier that displays your top 3 findings. Full access requires a one-time payment of $20 USD.

5.2 No Subscription

Your payment is a one-time transaction. You will not be charged again unless you initiate an additional purchase.

5.3 Refund Policy

Due to the immediate delivery of digital results, all sales are final. We do not offer refunds once your full report has been delivered. If you experience a technical issue that prevented you from accessing your results, contact support@flagsonar.com within 7 days of payment.

5.4 Scan Limits

Each account is limited to two scans: one initial paid audit and one free verification rescan. The verification rescan is available only after the user has addressed at least 85% of their findings. Scan limits are per account and non-transferable.

6. Intellectual Property

The Flag Sonar platform, brand, scoring methodology, and all related content are owned by Flag Sonar LLC. You retain ownership of your own social media data. By uploading your archive, you grant us a limited, temporary license to process it solely for the purpose of generating your audit report.

7. Prohibited Uses

You may not use Flag Sonar to:

  • Scan archives belonging to another person without their explicit written consent
  • Attempt to reverse-engineer, scrape, or replicate our scoring methodology
  • Use the Service for any unlawful purpose
  • Circumvent account or scan limits through multiple account creation
  • Misrepresent ownership of uploaded data

8. Disclaimers

Flag Sonar provides AI-generated analysis for informational purposes only. Our findings represent potential reputational risks based on pattern analysis — they do not constitute legal advice, employment advice, or a guarantee of any outcome. We make no warranty that our analysis is complete, accurate, or that addressing findings will prevent any specific consequence.

The Service is provided "as is" without warranties of any kind, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, Flag Sonar LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to lost opportunities, reputational harm, or employment outcomes. Our total liability to you shall not exceed the amount you paid for the Service.

10. Indemnification

You agree to indemnify and hold harmless Flag Sonar LLC and its officers, employees, and agents from any claims, damages, or expenses arising from your violation of these Terms, your misuse of the Service, or your violation of any third party's rights.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, with or without notice. Upon termination, your findings will be deleted from our systems within 30 days.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice within the Service. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Cook County, Illinois.

Flag Sonar LLC ("we," "us," or "our") is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your data.

2. Information We Collect

2.1 Account Information

When you create an account, we collect your name and email address. This is stored securely using Firebase Authentication (Google).

2.2 Archive Data

You voluntarily upload social media archive files for scanning. These files are processed temporarily and permanently deleted after your scan completes. We do not store your raw archive data.

2.3 Scan Findings

We retain the findings generated from your scan — including post snippets, risk scores, and associated metadata — and associate them with your account. This data is stored in Firebase Realtime Database and can be deleted by you at any time.

2.4 Payment Information

Payments are processed by Stripe. We do not collect, store, or have access to your credit card or banking information. Stripe's privacy policy governs their handling of payment data.

2.5 Usage Data

We may collect basic usage data such as scan timestamps, account creation date, and scan count. We do not use third-party analytics or advertising trackers.

2.6 Self-Certification Records

When you certify that an archive belongs to you, we log a timestamp of that confirmation associated with your account for legal compliance purposes.

3. How We Use Your Information

We use the information we collect to:

  • Provide and operate the Flag Sonar service
  • Deliver your audit results
  • Communicate with you about your account
  • Enforce our Terms of Service
  • Improve the Service

We do not sell your personal information to third parties. We do not use your data for advertising purposes.

5. Data Security

We use industry-standard security measures including Firebase Authentication, user-level database security rules, HTTPS encryption on all data in transit, and Stripe for PCI-compliant payment processing.

No system is completely secure. We cannot guarantee absolute security but take reasonable precautions to protect your data.

6. Your Rights

You may have the right to:

  • Access the personal data we hold about you
  • Delete your findings and account data
  • Correct inaccurate account information
  • Export your findings data

7. Children's Privacy

Flag Sonar is not intended for users under 18 years of age. We do not knowingly collect personal information from minors. If you believe a minor has created an account, contact us immediately.

8. Third-Party Services

We use the following third-party services:

  • Firebase (Google) — Authentication and database storage
  • Stripe — Payment processing
  • Anthropic (Claude API) — AI scanning and analysis
  • Netlify — Hosting and serverless functions

Each of these services has its own privacy policy governing their data handling.

9. California Privacy Rights (CCPA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act, including the right to know what personal information we collect and the right to request deletion. To submit a request, email support@flagsonar.com with the subject line "CCPA Request."

We do not sell personal information as defined under the CCPA.

10. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of material changes via email or a notice within the Service. Continued use after changes constitutes acceptance of the updated policy.
